The Psychosocial Expertise: When Can It Be Relevant?
A psychosocial expertise is an evaluation ordered by the Court, carried out by a social worker or a psychologist.
La question du choix d’école peut être à l’origine de certaines tensions puisqu’il arrive souvent que les parents ne s’entendent pas sur l’école à choisir pour leur enfant lorsque celui-ci atteint l’âge d’entrer à l’école ou même pendant son parcours scolaire.
Le choix d’école relève de la responsabilité des parents et fait partie de l’exercice de l’autorité parentale À défaut d’accord, les parents peuvent se tourner vers les tribunaux pour demander au juge de se prononcer sur le choix d’école ou sur une demande de changement d’école si l’enfant est déjà scolarisé.
Il n’y a pas d’article de loi visant spécifiquement la question du choix d’école. Au fils des années, les tribunaux ont créé une liste de critères à analyser lorsqu’il s’agit de se prononcer sur la question du choix d’école.
Cependant, il faut absolument garder en tête le fait que l’intérêt de l’enfant reste toujours au centre de toutes les décisions.
Voici une liste de quelques critères qui ont été retenus par les tribunaux pour déterminer quel établissement scolaire convient le mieux pour un enfant :
Cette liste de critères n’est pas exhaustive. Puisque les dossiers sont traités au cas par cas, il reviendra au Tribunal de déterminer si d’autres critères pourraient être pertinents.
Dans les cas, il faut noter qu’il revient au parent qui demande un changement d’école de démontrer que cette demande est conforme à l’intérêt de l’enfant
