Divorcing in Quebec or Abroad

When thinking about divorce, one automatically imagines a legal puzzle. The complexity can seem even greater when the marriage took place abroad. In such cases, is it more advantageous to divorce in Quebec or in the country where the marriage was celebrated? Many spouses wonder about the difference between divorcing in Quebec and divorcing abroad.

Divorcing in Quebec for a Marriage Conducted Abroad

Whether by mutual consent or in the context of a contested divorce, Quebec has the jurisdiction to issue a divorce judgment for a marriage conducted abroad – with the exception of certain countries. The procedure is the same as for a marriage celebrated in Quebec. It’s enough for one of the spouses to have been domiciled in Quebec for at least one (1) year.

It’s also necessary to consider the question of the matrimonial regime. In Quebec, the default regime is the partnership of acquests, whereas elsewhere, other regimes such as separation of property may apply.

Divorcing Abroad When Currently Living in Quebec

While initiating divorce proceedings abroad may seem daunting when considering the financial aspect and the delays in obtaining a judgment, it’s important to know that a divorce pronounced abroad may not be recognized by Canada. It would then be necessary to submit an applicable procedure in Quebec before a Quebec court.

It should also be specified that a Quebec divorce may not necessarily be recognized in all other countries.

Risks Related to Sponsorship When Divorcing Abroad

If you are planning to initiate a sponsorship procedure for a future spouse and are divorced from abroad, be aware that your marriage could be considered null under the Immigration and Refugee Protection Act, and your sponsorship application could then be refused.
